    当初から、秘密文書を入手するための手段として利用する意図で

    女　性　の　公　務　員　と　肉　体　関　係　を持ち、

    同女が右関係のため被告人の依頼を拒み難い
    心理状態に陥ったことに乗じて秘密文書を持ち出させたなど、
    取材対象者の人格を著しく蹂躪した本件取材行為は
    正当な取材活動の範囲を逸脱するものである。
